1) Scope

1.1 These General Terms and Conditions (hereinafter "GTC") of OneGo GmbH (hereinafter "Seller") apply to all contracts for the delivery of goods that a consumer or entrepreneur (hereinafter "Customer") concludes with the Seller with regard to the goods presented by the Seller in his online shop. The inclusion of the Customer's own conditions is hereby contradicted, unless otherwise agreed.

1.2 These General Terms and Conditions apply accordingly to contracts for the delivery of goods with digital elements, unless otherwise agreed. In addition to delivering the goods, the seller is obliged to provide digital content or digital services (hereinafter "digital products") that are included in or connected to the goods in such a way that the goods cannot fulfil their functions without them.

1.3 A consumer within the meaning of these General Terms and Conditions is any natural person who concludes a legal transaction for purposes that can predominantly neither be attributed to their commercial nor their independent professional activity.

1.4 An entrepreneur within the meaning of these General Terms and Conditions is a natural or legal person or a partnership with legal capacity who, when concluding a legal transaction, acts in the exercise of his or her commercial or independent professional activity.

2) Conclusion of contract

2.1 The product descriptions contained in the seller's online shop do not constitute binding offers on the part of the seller, but serve to submit a binding offer by the customer.

2.2 The customer can submit the offer using the online order form integrated into the seller's online shop. After placing the selected goods in the virtual shopping cart and completing the electronic ordering process, the customer submits a legally binding contract offer in relation to the goods contained in the shopping cart by clicking the button that completes the ordering process. By placing an order via this website, the customer agrees to our terms and conditions.

2.3 The seller can accept the customer's offer within five days by sending the customer a written order confirmation or an order confirmation in text form (fax or email), by delivering the ordered goods to the customer, or by requesting payment from the customer after placing the order. The contract is concluded at the time at which one of the aforementioned alternatives occurs first.

2.4 If a payment method is selected via PayPal, the payment will be processed in accordance with PayPal's terms of use. If "Shopify Payments" is used, the payment will be processed via the payment service provider Stripe. The offer is accepted at the moment the customer completes the order process.

2.5 The contract text will be saved by the seller after the contract has been concluded and sent to the customer in text form after the order has been sent. The contract text will not be made available beyond this unless the customer has set up a user account in the seller's online shop.

2.6 Various languages ​​are available for the conclusion of the contract, which are displayed in the online shop.

3) Right of withdrawal

3.1 Consumers generally have a right of withdrawal. The exact conditions and deadlines for the right of withdrawal can be found in the seller's cancellation policy.

4) Prices and payment terms

4.1 The prices stated are total prices. Any additional delivery and shipping costs are stated separately in the respective product description.

4.1.1 Depending on the order amount, the Federal Office for Customs and Border Security may charge a customs fee. You can find more information on the relevant website. There are no customs fees for our Swiss Made products as they are produced domestically and delivered directly to you.

4.2 For deliveries to countries outside Switzerland, additional costs may arise which must be borne by the customer, such as customs duties or fees for money transfers.

4.3 The payment options are communicated in the seller’s online shop.

4.4 If the customer chooses a payment method via PayPal or Shopify Payments, the payment will be processed via the respective payment service provider. In the event of a negative check result, the seller reserves the right to refuse the selected payment method.

5) Delivery and shipping conditions

5.1 Delivery will be made to the address provided by the customer. The delivery address is decisive for the processing of the transaction.

5.2 If delivery fails for reasons for which the customer is responsible, the customer shall bear the resulting costs. In the event of cancellation, the provisions in the cancellation policy apply.

5.3 The risk of accidental loss and accidental deterioration of the goods shall pass to the buyer upon handover to the carrier for entrepreneurs and upon handover of the goods to the customer for consumers.

5.4 The seller reserves the right to withdraw from the contract if the goods are not available. In this case, the customer will be informed immediately and any payments already made will be refunded.

6) Retention of title

The goods remain the property of the seller until the purchase price has been paid in full.

7) Liability for defects (warranty)

7.1 The statutory provisions on liability for defects apply. Different regulations may apply to entrepreneurs and consumers, as described in the specific sections of these General Terms and Conditions.

7.2 For entrepreneurs, the seller can choose the type of subsequent performance and the limitation period for defects is one year from delivery of the goods.

7.3 These limitations do not apply to claims for damages, fraudulently concealed defects or goods that were used for a building and caused its defectiveness.

7.4 Consumers should complain about obvious transport damage immediately upon delivery and inform the seller.

8) Redemption of promotional vouchers

8.1 Promotional vouchers can only be redeemed in the seller’s online shop and within the specified period.

8.2 Promotional vouchers cannot be redeemed for cash and are not transferable to other persons.

9) Data protection

The customer's personal data is protected in accordance with the statutory provisions. Further information can be found in the seller's privacy policy.

10) Applicable law and place of jurisdiction

10.1 The law of the Swiss Confederation applies, excluding the UN Convention on Contracts for the International Sale of Goods.

10.2 The place of jurisdiction for all disputes arising from this contractual relationship is the registered office of the seller, provided that the customer is a merchant. If the customer is a private individual (consumer), the statutory place of jurisdiction applies.

11) Alternative dispute resolution

The EU Commission provides a platform for online dispute resolution on the Internet at the following link: https://ec.europa.eu/consumers/odr

This platform serves as a contact point for the out-of-court settlement of disputes arising from online sales or service contracts involving a consumer.

11.1 The Seller is neither obliged nor willing to participate in a dispute settlement procedure before a consumer arbitration board.
